A Conviction Cannot Be Based on Doubt… The Presumption of Innocence Comes First

The case began with what appeared to be an ordinary incident, yet it culminated in a criminal charge after a rolled cigarette, alleged to have been mixed with hashish, was seized. Before the court, however, the accused denied the allegation attributed to him, but the panel nonetheless found him guilty and imposed a sentence of imprisonment together with a travel ban.

The judgment, however, was not the end of the matter, as the defense lodged an appeal on the basis that a conviction cannot be founded on doubt, that the presumption is one of innocence, and that where evidence is open to probability, it loses its probative value.

Takeaway:
In criminal cases, mere suspicion is insufficient to sustain a conviction, because doubt must be resolved in favor of the accused.
